Terms and Conditions
Scope
These Terms and Conditions (“T&Cs”) govern the contractual relationship between Jobmaps AG, Räffelstrasse 24, 8045 Zurich (“Jobmaps”), and registered visitors (“Users”) of the job marketplace (“Marketplace”) available at Jobmaps.ch and via an app provided by Jobmaps. These T&Cs apply to any use of the Marketplace and to all services offered by Jobmaps in connection with the Marketplace, unless otherwise agreed separately.
Jobmaps
Jobmaps is a job marketplace that supports employers and employees by providing tools to search for suitable jobs or candidates. Jobmaps improves the quality of information (employer and employee profiles) in the search process while reducing search costs (map search with all employers, list of interested candidates). This makes the search process more efficient for both parties and increases the likelihood of a match between job offers and job seekers.
The Marketplace includes claimed and unclaimed employer profiles. Unclaimed profiles are created by Jobmaps and enriched with publicly available data (e.g., commercial register entries, websites). Claimed profiles are verified and maintained by the respective employers (or their employees) and may be supplemented with their own content. Only claimed profiles can be used to post job listings.
Limitation
Jobmaps does not act as a recruitment agency and does not itself offer third-party jobs on the Marketplace. All jobs offered on the Marketplace are provided exclusively by third-party advertisers. Jobmaps is not a party to any employment contract related to such jobs, does not participate in the conclusion of such contracts, and does not represent any party involved.
Establishment and termination of the contractual relationship
The contractual relationship between Jobmaps and the User begins when the User registers and creates a user account. It may be terminated at any time, with immediate effect and without giving reasons, by deleting the user account.
Services of Jobmaps
General
The Marketplace is available only to individuals and companies with residence or registered office in Switzerland. By registering, the User confirms that they reside or are based in Switzerland.
Jobs in Switzerland (“Job Listings”) can be offered on employer profiles by employers, recruiters, etc. (“Advertisers”). Visitors can search for employers and their listings, and Users can apply or express interest (“Applicants”). In addition, Jobmaps may provide its own content and information on the Marketplace, the scope of which may change over time.
There is no contractual right to use the Marketplace. Jobmaps may, at any time, for any reason and without prior notice, change the Marketplace, including its scope of services, functions, design, or content.
Users have no right to demand the continuation of specific services, functions, designs, or content.
For Advertisers
Users can manage employer profiles and post job listings or vacancies on the Marketplace. Jobmaps may review job postings before publication and decline publication without giving reasons. Jobmaps may also remove published listings at any time, without notice or justification, in particular pursuant to Section 6.3 of these T&Cs.
Once published, the Marketplace provides an overview of incoming applications, enables communication between Advertisers and Applicants via messenger, and allows digital management of contact requests. Once a contract for the posted position has been concluded, the listing is removed but may be archived and reactivated if necessary.
For Applicants
Users can apply for job listings and employer profiles posted by Advertisers. Users may create and store an electronic profile in their account for this purpose. Jobmaps may delete profiles, especially if the User is inactive. Once contact is made, communication between Advertiser and Applicant can take place via messenger.
Additional services
Jobmaps may provide Users with additional paid services under separate contracts. Unless otherwise regulated in such contracts, these T&Cs apply.
Jobmaps may also allow Users to purchase services from third-party providers via the Marketplace. In such cases, the contract is concluded solely between the User and the third-party provider.
Users agree that Jobmaps may send them personalized messages electronically (e.g., by email or push notifications) with offers of potential interest. Such messages may be unsubscribed at any time via the link provided.
Ownership and usage rights
Ownership
All rights to the Marketplace and all associated content, including but not limited to software, design, trademarks, company names, and materials (text, images, video), belong exclusively to Jobmaps and/or its licensors. Users and visitors acquire no rights to the Marketplace or its content.
Exceptions apply to rights in job listings and profiles. By posting them, the User grants Jobmaps a free, irrevocable, transferable, and sublicensable license to use such rights and information for the intended purpose of the listing or profile.
Jobmaps may, in particular, publish listings on the Marketplace or elsewhere, integrate them into its own or third-party services, use them for its own purposes, make them accessible to third parties, distribute them via other channels (e.g., social media), and store and forward profiles to Advertisers.
User rights
With registration, Jobmaps grants the User a free, non-exclusive, non-transferable, non-sublicensable right, limited to the duration of the contractual relationship, to use the Marketplace and its content and functions as intended.
Intended use means: posting jobs (for Advertisers) and applying to jobs (for Applicants).
Any use beyond this, unless expressly agreed with Jobmaps, is prohibited. In particular, republishing or redistributing Jobmaps content or third-party listings without authorization is not permitted. Advertisers authorize Jobmaps to act against any unauthorized use of listings they post.
Rights of Jobmaps
Jobmaps may, at any time and without notice or reason, suspend or delete user accounts or remove listings, especially if it suspects a violation of these T&Cs, unlawful or unethical use, or unauthorized access to an account.
User obligations
Users must keep their login details secure and not share them with unauthorized persons.
Advertisers must provide accurate, complete, and up-to-date information in job postings and may only offer jobs they are authorized to fill.
Users must comply with applicable data protection laws.
Users are responsible for backing up their own data, including profiles and job listings.
Users must immediately report violations of these T&Cs, unauthorized account use, fraudulent postings, or suspected misuse to Jobmaps.
Users must ensure they have the technical requirements to use the Marketplace (e.g., current browser versions) at their own expense and take necessary measures to secure their systems.
Warranty exclusion, liability, and indemnity
Warranty exclusion
The Marketplace is provided “as is.” Jobmaps makes no representations, warranties, or guarantees regarding availability, service quality, accuracy, completeness, or timeliness of the Marketplace or its content, including listings and applicant profiles. Use of the Marketplace is at the User’s own risk.
Jobmaps is not obligated to verify information provided via the Marketplace (e.g., listings, profiles, communications). Each User is responsible for the accuracy and legality of their information.
Liability and indemnity
Jobmaps and its auxiliaries disclaim all liability for damages related to use or non-use of the Marketplace, including damages caused by unauthorized account access, unlawful or unethical behavior by Users or third parties (e.g., fraudulent listings), or data loss/deletion.
This disclaimer does not apply to damages caused by intent or gross negligence by Jobmaps, personal injury, product liability claims, or other claims that cannot be excluded by law.
Users agree to indemnify Jobmaps fully against claims from third parties arising from their use of the Marketplace, regardless of fault.
Changes to the T&Cs
Jobmaps may amend these T&Cs at any time. The current version is available on jobmaps.ch. Changes will be communicated appropriately. If a User disagrees, they must terminate the contract by deleting their account within two weeks of notification. Continued use of the Marketplace after notification constitutes acceptance of the new T&Cs.
Governing law and jurisdiction
Exclusive jurisdiction for disputes arising from or in connection with these T&Cs is Zurich, Switzerland. Jobmaps reserves the right to bring claims against the User in other competent courts in recourse or warranty cases. These T&Cs are governed by Swiss substantive law, excluding conflict-of-law rules.
