Who are we?

The following company is generally responsible for the processing of personal data in accordance with this privacy policy (“we” or “us”):

What personal data do we process and for what purposes?

Depending on the reason and purpose, we process different types of personal data. You will find more details in this section and in our general terms and conditions.

We generally collect your personal data directly from you, e.g., when you provide us with personal data, when you use our services, and when you communicate with us. This is the case, for example, when you provide your email address and your first and last name when creating a user account, or when you create a profile on our job marketplace jobmaps.ch as a job seeker.

However, personal data can also be collected from other sources. In particular, this applies to the following data and sources:

  • Information from public registers, e.g., the debt collection register, and from authorities;

  • Information from private information providers, such as commercial registers;

  • Providers of online services, e.g., internet analytics providers that collect information on our website and use it for evaluations (more information can be found in the section “How do we process personal data in connection with websites, apps, and email newsletters?”);

  • Information from financial service providers when you make payments to us;

  • Information we receive from a company for which you work, e.g., name, contact details, title, role, etc.;

  • Information about you provided by other people, e.g., in the course of communication with us, via our online forms, or in connection with legal or administrative proceedings.

We primarily process your personal data to provide and deliver our services, in particular to enable you to apply for job postings, publish job postings, communicate with advertisers and job seekers, or use our online forms, for the purposes listed below, and for other purposes that we communicate to you separately or that are obvious:

  • To communicate with you and third parties;

  • To provide, manage, secure, and personalize websites, apps, online offerings, and other infrastructure;

  • To conclude and perform contracts with you;

  • To conclude and perform contracts with our suppliers, customers, and business partners with whom you are connected, and for customer relationship management;

  • To better understand our end customers, their behavior, and preferences, and to assess and improve the acceptance of our services and communication;

  • On behalf of our customers, to assess your financial standing;

  • For advertising and marketing purposes, e.g., organizing events, competitions, and for sending targeted information and marketing communications by post and electronically (unless the recipient has objected to direct marketing);

  • For managing and operating our IT and other resources;

  • For accounting, archiving, training, and other administrative purposes;

  • To review and improve our internal processes;

  • To ensure the security of our employees, buildings, and premises;

  • To comply with legal obligations, including court or regulatory orders; for compliance and to detect, investigate, and prevent misuse;

  • To enforce our claims and those of affiliated companies, and to defend against claims brought against us, our employees, affiliated companies, and our contractual and business partners in courts and before authorities in Switzerland and abroad.

We may also act as a data processor on behalf of our customers, e.g., when we send messages to individuals who are not users of our platform on behalf of advertisers and job seekers. In such cases, you will be informed about the processing directly by the relevant controller.

To whom do we disclose your personal data?

Our employees have access to personal data where necessary for the purposes described and for their respective roles, including support staff. They act under our instructions and are bound to confidentiality.

If you apply as a job seeker to a job posting on our job marketplace jobmaps.ch, we will forward the personal data you provided in your profile to the respective advertiser. If you publish a job posting as an advertiser, we will publish it on our marketplace and possibly elsewhere. Any personal data contained in the posting may also be published. We may also disclose the identity of advertisers to job seekers.

If a user sends information (including documents) to other users or third parties via our marketplace, we pass this information, including any personal data, on to the intended recipient.

On our website, you may obtain various services from third-party providers. When you use such services, we provide the third party with your personal data as necessary (usually personal details, date of birth, and contact information). We are not responsible for how third parties process such data.

We may also disclose personal data to third parties if we use their services (e.g., IT providers). In some cases, we may also transfer personal data to other companies for their own purposes. In such cases, the recipient is independently responsible under data protection law. Examples include:

  • When we publish job postings on third-party platforms on behalf of clients, we forward your communication regarding such postings to the relevant client and facilitate electronic communication between you and the client on our systems.

  • When a user sends messages via our marketplace to third parties, we forward those messages.

  • We may disclose your personal data to courts and authorities in Switzerland and abroad if required by law. We also reserve the right to process your personal data to comply with a court order, assert legal claims, or defend against them, or if we otherwise consider it necessary for legal reasons. In such cases, we may also disclose your personal data to other parties to the proceedings.

  • We may transfer claims against you to other companies, such as debt collection agencies.

  • Disclosure of personal data to third parties for their own purposes will only take place with appropriate notice and your consent, where legally required. For example, personal data is only shared with third parties for their own marketing purposes with your explicit consent.

When do we transfer your personal data abroad?

Recipients of your personal data may be located abroad, including outside Switzerland and the EU/EEA. Such countries may not provide the same level of data protection as Switzerland or the EU/EEA. If we transfer your personal data to such a country, we will ensure adequate protection of your personal data, e.g., by concluding data transfer agreements with the recipients. Please contact us if you would like a copy of such agreements.

How do we process personal data in connection with websites, apps, and email newsletters?

When you visit or use our website and app, we process technical data such as access time, visit duration, visited pages, and information about the device used, in order to provide the website and app, for IT security reasons, and to improve user experience.

We also use “cookies” and similar technologies. Some cookies are necessary for website and app functionality and are automatically deleted after use. Others store preferences (e.g., language) for future visits or provide anonymous usage statistics. These do not require your consent.

We may also use cookies for interest-based advertising on partner websites, but only with your consent. Third-party cookies may also be used for statistical purposes. For example, we use Google Analytics, a service from Google in the USA. Google uses cookies to analyze your use of our website. Your IP address is shortened within the EU/EEA before being transferred to the USA. This use requires your consent. You can prevent Google Analytics by installing a browser add-on: https://tools.google.com/dlpage/gaoptout.

If we send newsletters by email, we can determine whether and when you opened the email. You can disable this tracking in your email program.

You can prevent cookies by adjusting your browser settings, uninstalling or configuring apps, or adjusting your email settings.

How long do we store your personal data?

We store your personal data in identifiable form for as long as necessary for the purpose for which it was collected. For contracts, this is generally at least for the duration of the contractual relationship.

For example, your profile on jobmaps.ch remains available as long as you are active; inactive profiles are deleted within a reasonable period. Job applications are deleted after acceptance within a reasonable period, and after rejection usually within 7 days. Applications via third-party platforms are deleted after the job posting is removed.

We may also store personal data where we have a legitimate interest, e.g., for documentation, evidence, and legal defense. In addition, we retain personal data for as long as required by legal retention obligations.

How do we protect your personal data?

We implement appropriate technical measures (e.g., encryption, pseudonymization, logging, access restrictions, backups) and organizational measures (e.g., staff instructions, confidentiality agreements, audits) to protect your personal data against unauthorized or unlawful processing, loss, alteration, disclosure, or access.

What rights do you have in relation to your personal data?

You may object to data processing at any time, particularly to processing for direct marketing purposes (e.g., advertising emails).

Under applicable law, you also have the right to access, rectify, delete, restrict processing, and object to processing. You also have the right to receive personal data you provided to us in a readable format free of charge.

You may withdraw consent at any time without affecting the lawfulness of prior processing. You may also lodge a complaint with the competent data protection authority.

What else should you know?

Our processing of personal data is based in particular on the following legal grounds:

  • Fulfillment of a contract with the data subject or pre-contractual measures at their request;

  • Legitimate interests (e.g., customer care, communication, marketing, fraud prevention, IT security, business operations, company development, enforcement of claims, compliance with Swiss law and internal rules, etc.);

  • Consent, if we request it separately;

  • Legal obligations.

Providing personal data is generally not mandatory unless required by contract or law. However, we need certain data to establish or perform a contract. Without it, the contract cannot be concluded or maintained. Log data and certain other data are technically necessary when using websites and apps.
